Arizona Misdemeanor Classes & Maximum Penalties

Each of Arizona’s three misdemeanor classes carries maximum potential penalties, not an automatic sentence. The actual consequences can depend on the offense, prior record, applicable mandatory minimums, negotiated resolution, and sentencing decision.

Maximum penalties by class:

• A Class 1 misdemeanor is the most serious misdemeanor classification in Arizona. The maximum baseline penalties are six months in jail and a $2,500 fine plus applicable surcharges. Arizona law also allows for up to three years of probation for a Class 1 misdemeanor.
• A Class 2 misdemeanor carries a maximum of four months in jail and a $750 fine plus applicable surcharges. Arizona law also allows for up to two years of probation for a Class 2 misdemeanor.
• A Class 3 misdemeanor carries a maximum of 30 days in jail and a $500 fine plus applicable surcharges. Arizona law also allows for up to one year of probation for a Class 3 misdemeanor.

These figures describe general maximum penalties. Offenses such as DUI and certain domestic violence matters may involve mandatory minimum penalties or additional requirements. Arizona Revised Statutes § 13-707 also provides that a repeat conviction for the same misdemeanor or petty offense within the applicable statutory period may be sentenced at the next higher classification.

Diversion Programs & Other Possible Resolutions

Depending on the evidence and legal issues, a misdemeanor case may end in dismissal, diversion, a negotiated plea, a charge reduction, acquittal, or trial.

Arizona diversion programs may allow a qualifying defendant to complete specified conditions while prosecution is suspended. Requirements can include:

• Completing educational or treatment classes
• Performing community service
• Paying restitution when required
• Complying with program conditions for a specified period

Diversion isn’t available in every case, and first-time status doesn’t guarantee acceptance. Eligibility depends on the offense, prior record, prosecutor, court, and applicable program. Successful completion may lead to dismissal when the program provides for that result.

The impact depends on the offense and the person’s employment, licensing, immigration status, housing, and other circumstances.

• Employment Hurdles: Employers may consider a conviction during a background check, particularly when the alleged conduct relates to the duties of the position.
• Professional Licensing: A licensing board may require disclosure or review a conviction under profession-specific rules.
• Housing: A criminal record may affect a landlord’s review of a rental application.
• Immigration Status: Certain convictions can create immigration consequences depending on the offense and individual status.
• Firearm Rights: Certain domestic-violence-related convictions may affect firearm possession under federal law when the statutory requirements apply.

A misdemeanor conviction doesn’t necessarily remain publicly accessible without any possibility of relief. Arizona law provides set-aside and record-sealing remedies in qualifying circumstances. Eligibility is offense-specific, isn’t automatic, and should be evaluated based on the conviction and applicable law.
