What is Solicitation?

Solicitation generally refers to offering, agreeing to pay, or requesting another person to engage in prostitution or other unlawful sexual acts in exchange for money or something of value. Law enforcement agencies throughout Arizona regularly conduct undercover operations aimed at identifying individuals suspected of engaging in solicitation-related offenses.

In many cases, solicitation charges arise from:

In Arizona, prostitution and solicitation are heavily criminalized. Under A.R.S. § 13-3214, knowingly engaging in prostitution or solicitation is classified as a Class 1 misdemeanor. Furthermore, local municipalities like the City of Phoenix enforce their own strict codes (Phoenix City Code § 23-52) that mirror or exceed state penalties.

Arizona is unique because its statutes strip judges of the discretion to waive jail time. Even for a first-time, otherwise law-abiding offender, a conviction carries mandatory minimum jail sentences that cannot be suspended or replaced entirely by probation.
