What is Indecent Exposure?

In Arizona, indecent exposure is strictly defined under Arizona Revised Statutes (A.R.S.) § 13-1402. The law states that a person commits indecent exposure if they intentionally expose their anus, genitals, or the areola or nipple of the female breast, and another person is present who could be offended or alarmed by the act.

To secure a conviction, the state prosecutor must prove two core elements beyond a reasonable doubt:

  1. Intent: The exposure must be intentional, reckless, or done for sexual gratification or irritation. Accidental exposure does not meet the statutory definition of the crime.
  2. Presence of Others: The act must occur in a setting where another person is actually present and likely to experience alarm, offense, or distress.

It is important to note that the law specifically excludes breastfeeding from the definition of indecent exposure. A mother has an absolute legal right to breastfeed her child in any public or private location where she is otherwise authorized to be.

Common Examples of Indecent Exposure

Indecent exposure charges encompass a wide variety of behaviors. While some cases involve overt sexual misconduct, many arrests stem from poor judgment, intoxication, or misunderstandings. Common scenarios that lead to an arrest in Phoenix include:

  • Public Urination: Peeing in an alleyway, behind a bar, or in a parking lot is frequently charged as indecent exposure if genitals are visible to passersby.
  • Streaking or Public Nudity: Stripping down or running naked in a public space, often fueled by a dare or alcohol consumption.
