Tax Evasion Is Different From Simply Owing Tax
An unpaid tax balance does not automatically establish criminal tax evasion.
Under 26 U.S.C. §7201, the government generally must prove three essential elements:
- An additional tax due and owing
- Willfulness
- An affirmative act intended to evade or defeat the tax or its payment
Willfulness in the federal tax context means a voluntary and intentional violation of a known legal duty.
The affirmative-act requirement also matters. Passive nonpayment or failure to file, standing alone, does not necessarily establish tax evasion under §7201. Prosecutors generally must identify conduct they claim went beyond an omission and constituted an attempt to evade assessment or payment.
Alleged affirmative acts can include conduct such as concealing assets, keeping false records, using nominees, making false statements, or filing a false return, depending on the facts.

How to Respond to an IRS Criminal Investigation
The correct response depends on the stage and nature of the matter.
A civil IRS examination is different from a subject criminal investigation conducted by IRS Criminal Investigation. A grand jury subpoena, executed search warrant, or contact from a special agent can raise additional criminal concerns.
Before responding substantively, voluntarily providing records, or agreeing to an interview, legal counsel can help determine:
- Which IRS or federal personnel are involved
- Whether you are being treated as a witness, subject, or target
- Whether a grand jury investigation is underway
- What records or testimony are being requested
- Whether there are deadlines or legal obligations requiring a response
- Whether a parallel civil tax matter also exists
Preserve relevant records and communications after learning of an investigation. Do not alter, destroy, fabricate, or backdate documents.
