Counterfeiting Attorney in Phoenix
State & Federal Counterfeiting Defense Backed by Independent Investigation
Counterfeiting allegations can involve counterfeit marks on branded goods, forged documents or financial instruments, counterfeit currency, or other United States obligations and securities. These allegations do not all arise under the same law. The item involved, the alleged conduct, and the investigating agency can determine whether Arizona law, federal law, or multiple statutes are at issue.
Cates & Reed, PLLC represents clients in Arizona state and federal criminal cases, including white collar and high-stakes federal matters. Our initial review focuses on what investigators claim you possessed, produced, sold, transferred, or distributed, what you allegedly knew, and whether the government can prove the intent required by the charged offense.
Call Cates & Reed, PLLC at (480) 864-3807 to discuss a counterfeiting investigation, arrest, indictment, or criminal charge with our Phoenix attorneys. You can also contact us online.
Criminal Defense Grounded in Investigation & Preparation
Since 1997, we have defended Arizona clients against criminal charges. Our attorneys have collectively handled thousands of cases in state and federal courts, and Dwane Cates is board-certified in Criminal Law by the State Bar of Arizona.
Clients work directly with our attorneys throughout their cases. We also conduct an independent defense investigation rather than relying solely on the government’s account. Depending on the allegations, our review may include reports and recordings, seized merchandise or documents, financial records, digital evidence, witness interviews, search warrants, and law-enforcement procedures.
Our white collar criminal defense practice includes cases involving financial records, allegations of fraud or deception, and investigations that may overlap with federal law.
What We Examine in a Counterfeiting Case
The required elements depend on the statute charged and the type of item involved.
Issues may include:
- Knowledge: Whether the evidence proves you knew an item, mark, instrument, or currency was counterfeit or forged.
- Intent: Whether prosecutors can establish an intent to sell, distribute, deceive, or defraud as required by the applicable statute.
- Possession or control: Whether the property was actually within your possession, custody, or control.
- Authenticity: Whether reliable evidence establishes that the goods, marks, documents, or currency were counterfeit or forged.
- Quantity and value: In Arizona counterfeit-mark cases, the number of items and aggregate retail value can affect classification.
- Evidence handling: Whether seized items were properly documented and preserved.
- Search and seizure: Whether officers had lawful authority to obtain physical or digital evidence.
- Statements: Whether investigators lawfully obtained statements and whether the full context supports the government’s interpretation.
Arizona Counterfeit-Mark Charges Under A.R.S. § 44-1453
Arizona Revised Statutes § 44-1453 addresses counterfeit marks on goods and services.
The statute generally prohibits knowingly and with intent to sell or distribute using, displaying, advertising, distributing, offering for sale, selling, or possessing an item bearing a counterfeit mark or a service identified by a counterfeit mark.
A counterfeit mark includes certain unauthorized reproductions or copies of intellectual property and intellectual property placed on goods or services without authorization from the intellectual-property owner.
