Vehicle Assault Attorney in Phoenix

Trial-Ready Defense for Phoenix Vehicular Assault Allegations

Arizona does not have a standalone criminal offense called vehicular assault. Depending on the facts, prosecutors may instead pursue aggravated assault under A.R.S. § 13-1204 when they allege that a driver committed an underlying assault and that serious physical injury, use of a vehicle as a dangerous instrument, or another statutory aggravating circumstance was present.

Cates & Reed, PLLC provides personalized criminal defense backed by more than 35 years of combined experience defending Arizonans. We prepare every case with trial in mind and independently examine the evidence rather than relying solely on the account developed by law enforcement.

Founding attorney Dwane Cates is Board Certified by the State Bar of Arizona as a Specialist in Criminal Law, a credential relevant to serious felony defense.

Call (480) 864-3807 or contact us online to arrange a case evaluation with our vehicular assault defense lawyers in Phoenix.

What Happens After You Contact Our Firm

The first step is to request a case evaluation by phone or through our contact form. Our phone line is available 24/7, so you can contact us when an arrest, investigation, or pending court date requires prompt attention.

Clients work directly with our lawyers throughout their cases. This direct access allows us to discuss the allegations, explain the current stage of the case, and identify the records and evidence that may require review.

We conduct our own investigation rather than relying solely on the State’s interpretation of the incident. Depending on the facts, that work may involve physical evidence, witness accounts, police reports, medical information, vehicle evidence, toxicology evidence when impairment is alleged, and the circumstances surrounding the collision.

Arizona Law on Aggravated Assault Involving a Vehicle

An aggravated assault charge under A.R.S. § 13-1204 requires an underlying assault as defined by A.R.S. § 13-1203.

Arizona law recognizes assault when a person:

  • Intentionally, knowingly, or recklessly causes physical injury to another person;
  • Intentionally places another person in reasonable apprehension of imminent physical injury; or
  • Knowingly touches another person with the intent to injure, insult, or provoke.

The State must then prove an aggravating circumstance listed in § 13-1204.

Two provisions are particularly relevant in cases involving vehicles. Aggravated assault can be charged when an assault causes serious physical injury or when the person uses a deadly weapon or dangerous instrument.

Arizona defines a dangerous instrument as anything that, under the circumstances in which it is used, attempted to be used, or threatened to be used, is readily capable of causing death or serious physical injury. A vehicle can qualify under that definition depending on how it was allegedly used.

Our aggravated assault defense practice addresses the broader statutory framework that applies to these felony charges.

DUI, Recklessness & Vehicle Assault Allegations

Some aggravated assault cases involving vehicles also involve allegations of alcohol or drug impairment, but DUI is not a required element of every vehicle-based aggravated assault case.

For an assault based on physical injury under A.R.S. § 13-1203(A)(1), the State may rely on intentional, knowing, or reckless conduct.

Arizona defines recklessness in part as consciously disregarding a substantial and unjustifiable risk. The law also addresses circumstances in which a person creates such a risk but fails to perceive it solely because of voluntary intoxication.

Evidence of impairment can therefore be relevant when prosecutors attempt to prove recklessness. It does not eliminate the State’s burden to prove the underlying assault and the aggravating circumstance required by § 13-1204.

Cases involving DUI allegations may also raise separate issues under Arizona’s DUI defense laws.
