Common Weapon Charges We Defend Against

Understanding the different types of weapon charges is essential to building a strategic defense. Below are some common weapon charges we defend against:

Misconduct Involving Weapons (MIW)

Misconduct involving weapons (MIW) covers a broad range of illegal actions under A.R.S. § 13-3102, including prohibited possessors, unlawful carry, and possession of prohibited weapons.

Possession of a Weapon by a Prohibited Person

Firearm possession by felons, domestic violence offenders, or those adjudicated as mentally incompetent is illegal under A.R.S. § 13-3102(A)(4).

Using or Possessing a Weapon During a Felony

Using or possessing a deadly weapon during the commission of another felony can increase the severity of charges (A.R.S. § 13‑3102(A)(8)).

Unlawful Discharge of a Firearm

Unlawful discharge of a firearm occurs when someone intentionally, knowingly, or recklessly fires a gun in a way that endangers others or property, or in certain prohibited locations (A.R.S. § 13-3107). This can include shooting in public areas, near buildings, or in a manner that puts people at risk, even if no one is injured.

Facing a weapon charge can be daunting, but you don’t have to fight it alone. Call (480) 864-3807 to schedule a consultation with our weapon defense attorneys.
