How Is Murder Defined in Arizona?
Arizona law classifies murder as one of two degrees:
- First-degree murder is committed by killing another person intentionally and with premeditation, meaning the offender planned or reflected on the act before doing it (A.R.S. § 13-1105).
- Second-degree murder is committed by causing a death intentionally, knowingly, or recklessly, but without premeditation (A.R.S. § 13-1104).
State law also recognizes lesser homicide offenses, such as manslaughter and negligent homicide.
What Are the Penalties for a Murder Conviction?
The penalties for a murder conviction depend on the degree, the circumstances of the offense, and prior convictions. Murder in the first degree is a Class 1 felony punishable by death or life in prison. Murder in the second degree is also a Class 1 felony punishable by 10–25 years in prison.
Defendants facing second-degree murder charges with prior homicide or felony convictions can receive an enhanced sentence of 15–29 years in prison (A.R.S. § 13-710). If the victim was an unborn child or under the age of 15, this constitutes a Dangerous Crime Against Children (DCAC) that carries harsher sentencing, including life in prison without parole (A.R.S. § 13-705(D)).
